Mr. Blahnik is a Minnesota probate attorney and handles both testate proceedings and intestacy proceedings.  When an individual dies without a Will, that person dies "intestate."  In such a situation, that person's estate passes to that person's family members as determined by statutue.  When someone dies having executed a Will, the Courts refer to that as a "testate proceeding."  In such a case, and unless otherwise disputed, that person's probate estate will pass according to his or her Will. 

 

What constitutes a person's "probate estate?"  Probate assets include any and all assets that are owned solely by that person without a beneficiary.  So, any assets owned in joint tenancy, tenancy in common, or any accounts with benficiaries do not constitute probate assets.  Such assets would be transfered to the joint tenant or beneficiary at the time of the person's death.
